E2 VISA Qualification Includes:
 You must be a national of a treaty country, UK is a treaty country- The investment must be "substantial"
- Percentage of cash investment is usually higher for low cost enterprises and less so for a higher cost enterprise
- The business must be a real & operating enterprise
- The business must generate a significantly more income than needed just to sustain the owners/dependants - it must not be what is considered “marginal”
- There must be a positive impact on the US economy, such as employees
- The owners must have control of the funds, the $ must actually be invested and at risk
- Loans secured on the business itself are not counted, however finance raised via personally secured loans/mortgages are
Other factors:
- Marginal means the business does not generate significantly more than the funds required by the owners to provide a living for them and immediate family
- E2 visa holders may continue to reside in USA so long as they continue to qualify for the E2 visa and its conditions
